What Is Excised Land in Lagos and Is It Safe to Buy?

If you have shopped for land in Lagos, particularly in areas like Ibeju-Lekki, Epe, Ajah, or Ikorodu, you have almost certainly encountered the term "excised land." Many sellers use it loosely. Here is what it actually means and how to assess whether it is safe to buy.

What Does Excision Mean?

When the Lagos State Government acquires land, whether for development, infrastructure, or general state ownership, entire communities and villages can fall within those acquired boundaries. Over time, communities can petition the government to have a portion of that acquired land released, or "excised," back to them for communal use.

An excision is therefore an official government action that releases a defined parcel of land from government acquisition and returns it to a community or family. This excised land is then published in the Lagos State Official Gazette, a government legal publication, which is why you will often hear "gazetted land" used alongside excised land.

The Gazette Is the Key Document

For excised land, the most important document is the Government Gazette (commonly called the Gazette). It contains:

  • The legal description and survey plan of the excised area
  • The gazette number and date of excision
  • The acreage and boundaries of the released land

When a seller offers you "excised land," ask for the gazette number. Then verify it at the Lagos State Lands Bureau or the Office of the Surveyor General. If no gazette exists, the excision claim is unverified and you should not proceed.

Is Excised Land Safe to Buy?

Excised land can be safe to buy, but only when properly verified. Here is the framework:

Safe indicators:

  • Gazette number exists and verifies at the Lands Bureau
  • The specific plot you are buying falls within the gazetted boundaries (your surveyor must confirm this)
  • The community or family selling has a clear and agreed authority structure with no multiple factions selling the same land
  • A licensed lawyer conducts a title search before payment

Red flags:

  • Seller cannot produce a gazette number
  • The seller is an individual with no traceable link to the community or family
  • The plot coordinates do not fall within the gazetted area per the survey
  • The price is unusually low, with pressure to pay quickly

What Title Can You Get on Excised Land?

After buying the excised land, you can apply for a Certificate of Occupancy (C of O) from the Lagos State Government. The gazette is the foundation for that application. This is one of the pathways through which private individuals obtain C of Os in Lagos, buying family or community excised land and then regularizing it through the government.

The Bottom Line

Excised land is a legitimate land category in Lagos. Many thriving estates and neighbourhoods sit on excised land. The risk is not in the category; it is in buying without verification. Always confirm the gazette, confirm your plot falls within it, and always use a lawyer.
